Terms and Conditions of Service for Personal Training and Online Coaching

IMPORTANT NOTICE

PLEASE READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY BEFORE USING OUR SERVICES. BY ACCESSING, PURCHASING, OR USING ANY LEPPAN PHYSIQUES PTY LTD SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.

1. Revision and Updates

Leppan Physiques Pty Ltd (“Leppan Physiques”, “we”, “us”, or “our”) may revise or update these Terms at any time. Updated Terms will be effective immediately upon publication on our website. Continued use of the Services constitutes acceptance of the revised Terms.

2. Disclaimer and Medical Advice

All information provided by Leppan Physiques Pty Ltd, whether through our website, application, email, or coaching communication, is general in nature and provided for educational purposes only. Leppan Physiques Pty Ltd is not a medical provider and does not provide medical advice.

You acknowledge that you should consult a qualified medical professional before beginning any exercise or nutrition program. Participation is at your own risk.

3. Onboarding Process and Privacy

To access our Services, you must provide complete, accurate, and truthful information during onboarding. Failure to disclose relevant medical or physical conditions may result in refusal or termination of service.

Your personal data is handled in accordance with our Privacy Policy.

4. Fees, Charges, and Payment Authorisation

4.1 Fees

Certain Services require payment. You agree to pay all applicable fees at the rates disclosed at the time of purchase.

4.2 Authorisation of Charges

By entering payment details and completing checkout, you expressly authorise Leppan Physiques Pty Ltd to charge your nominated payment method for all agreed fees, including:

  • Recurring subscription charges

  • Minimum-term commitments

  • Failed payment retries

  • Outstanding balances

All transactions processed through our payment systems are authorised transactions.

5. Minimum Term, Billing, Pauses, and Non-Engagement

5.1 Minimum Term Commitment

All coaching services are subject to a minimum commitment of twelve (12) consecutive weekly payments. This is a payment-based commitment, not a usage-based commitment, and applies regardless of participation level, engagement, or delays in commencement.

5.2 Automatic Renewal

Subscriptions renew weekly unless cancelled in accordance with these Terms.

5.3 Cancellation Notice

A minimum of four (4) weeks’ written notice is required to cancel a subscription. Cancellation requests must be submitted via the designated cancellation process.

5.4 Pause Policy

Clients may request one pause of up to four (4) weeks during the minimum term, subject to approval.

  • A minimum of two (2) weeks’ notice is required

  • During a full pause, app access is disabled and billing is suspended

  • Optional program-access-only pause is available at $35/week

Pauses do not reduce the minimum payment obligation.

5.5 Delays, Non-Engagement, and Inactivity

Requests to delay, pause commencement, or reduce engagement do not cancel or suspend billing unless expressly confirmed in writing by Leppan Physiques Pty Ltd.

Failure to engage, respond, or participate does not constitute cancellation.

5.6 Failed Payments and Retries

If a scheduled payment fails, we may retry the payment using the authorised payment method. Clients remain responsible for all outstanding balances.

6. Refund and Chargeback Policy

Due to the customised nature of coaching services and immediate access to proprietary materials, all payments are non-refundable once processed, except where required by law or expressly agreed in writing.

Clients agree not to initiate chargebacks or payment disputes for authorised transactions, minimum-term commitments, or services delivered in accordance with these Terms.

Where a refund is agreed in writing, it will be processed within a reasonable timeframe using the original payment method. Initiating a dispute before completion of an agreed refund process constitutes a breach of these Terms.

7. Delivery of Services

Access to training programs, nutrition guidance, and coaching tools is granted upon successful payment and onboarding.

8. Indemnity

You agree to indemnify and hold harmless Leppan Physiques Pty Ltd from any claims arising from your use of the Services.

9. Conduct

Clients must not misuse the Services, harass staff or clients, distribute harmful content, or engage in unlawful activity. Breach may result in termination.

10. Outstanding Fees, Default, and Recovery

Failure to fulfil payment obligations may result in:

  • Suspension or termination of services

  • Referral to Marshall Freeman Co. for debt recovery

  • Liability for all recovery costs

  • Legal proceedings

10.1 Chargeback Misuse

Initiating disputes or chargebacks for authorised transactions or minimum-term commitments may result in immediate termination and recovery action.

11. Legal Capacity

You confirm that you are at least 18 years of age and legally capable of entering into this agreement.
